Thank you for signing up with Jive. Jive is a mobile application designed as a platform for meeting other singles. These Terms and conditions constitute a legal agreement between you and Nevij B.V. a company established in the Netherlands. Jive is a social media application designed as a tool for meeting  singles. The intention of the application is to bring people together and have fun. It is important to us and also for you that the application remains save and friendly therefor you need to agree that you will use Jive consistently with its purpose and in accordance with these terms and conditions and our Privacy Policy.

Definitions

  • Account: the personal part of the user with which the user registers and gains access to the application.
  • User: the person who has registered through his account in order to make active use of the application
  • Jive: a geo-social meeting application (app) for smartphones that allows users to rate other users based on their profile photos and similarity
  • Application: The Jive application is available in the all common App Stores.
  • The operator: Nevij B.V.
  • Standard app: the application as downloaded with a match report up to a distance of 150 meters
  • The Application: Jive

Summary

Please read these terms in full, as they apply each time you visit Jive and use any of its features. However. In case you ever want to check something out very quickly, below is a summary of the most important points.

  1. If you are under the age of 18 then unfortunately you can’t use Jive yet because it’s a tool for adults only.
  2. We are not responsible for the consequences of your actions in any form while using the application.  We do not monitor your visits or use of the application in any way, but if we see anything or someone alerts us that your actions are inappropriate then we are permitted to take the appropriate action in our sole discretion.
  3. If you are concerned about how your data is being used by Nevij then please refer to our Privacy Policy, which explains how we treat your personal data and protect your privacy when you use Jive. By using Jive, you agree that we can use such data in accordance with our Privacy Policy. Our website and apps also use cookies or similar technologies which we tell you more about here. You may set your browser and your mobile settings to block cookies and local storage devices, but if you do so, you may not be able to access the features that Jive offers.
  1. The Legal Part

By Creating a Jive account you constitute a legal agreement between you as user (“you”) and Nevij B.V., a company based in the  he Netherlands. The Terms and Conditions apply whenever you use Jive. By accessing, using, registering with, you are accepting and agreeing to be bound by the terms and conditions.

We will change this agreement from time to time and adapt it to Jive’s development. We may do this for a variety of reasons including to reflect changes in or requirements of the law, new features, or changes in business practices. The most recent version of this Agreement will be posted on our website Jivesingles.com , Therefore you should regularly check the site for the most recent version. The most recent version is the version that applies. If the changes include material changes that affect your rights or obligations, we will notify you of these changes in advance. The changes will be communicated via the app or on the website. If you continue to use the application after the changes become effective, then you agree to the revised Agreement.

  1. Eligibility

Jive is an application developed for adults. You may only use Jive if you are 18 years or older. You warrant that you have the right, authority and capacity to enter into and be bound by the Terms and that by using Jive you will not be violating any law or regulation of the country in which you are resident. You are solely responsible for your compliance with all applicable local laws and regulations.

You further warrant that you have not been convicted of, nor are subject to any court order relating to assault, violence, sexual misconduct or harassment.

  1. Your account

At first you need to download the Jive Application from one of the available App Store. In order to create an account you need to enter your profile-name, age, gender and upload a profile photo. Add two locations where you are never “discoverable” (safe zone), your specific profile will automatically disappear if somebody enters your safe zone.

To protect your privacy:

  • you do not have to enter an email address or phone number
  • you do not need a Facebook account to log in
  • there is always a possibility to make your app profile invisible
  1. Termination

If you have an account and profile you can terminate this at any time by using the remove buttons while in the application and removing the application from you smart phone. Whenever you decide to use it again the process start from scratch and while accepting the Terms and Conditions a new agreement will be in place.

  1. Modifications to our application

Jive, as any other application is always busy to improve the application and bring you additional functionality that you may find engaging and useful. This means we will add new product features or enhancements from time to time as well as remove some features, and if these actions do not materially affect your rights or obligations, we may not communicate this before taking them. We may even suspend the Service entirely, in which event we will notify you in advance unless extenuating circumstances, such as safety or security concerns, prevent us from acting so.

  1. Purchases and Payment

Jive offers you the opportunity to pay for additional user time above and on top of you free daily user time. If you choose to make such a purchase you agree to pay Jive all charges in line with the prices displayed for the services you have selected as well any sales or similar taxes that may be imposed on you payments, and you authorize Jive to charge the chosen payment provider. If and when you initiate a chargeback or otherwise reverse a payment made with your payment Method, Jive may terminate you account immediately in its sole discretion

  1. Refunds

Generally, all charges for purchases are non-refundable, and there are no refunds or credits for partially used periods. We may make an exception if a refund for a subscription offering is requested within fourteen days of the transaction date, or if the laws applicable in your jurisdiction provide for refunds.

For subscribers residing in the EU or European Economic Area, in accordance with local law, you are entitled to a full refund during the 14 days after the subscription begins. Please note that this 14-day period commences when the subscription starts.

Purchases of Virtual Items are FINAL AND NON-REFUNDABLE.

To request a refund: If you subscribed using your Apple ID, refunds are handled by Apple, not Jive. To request a refund, go to iTunes, click on your Apple ID, select “Purchase history,” find the transaction and hit “Report Problem”. You can also submit a request at https://getsupport.apple.com.

  1. Rules of engagement

By using the Jive application, you agree that you will not:

  • impersonate any person or entity or upload any person than yourself
  • harass, mistreat, bully, intimidate, assault or defame any person
  • use the Application for any purpose that is illegal or prohibited by this Agreement
  • use another persons user’s account
  • use the Application for any harmful or nefarious purpose
  • use the Application in order to harm or damage Nevij B.V. as the operator of Jive
  1. Interaction with Other users

Although the interaction is the result of using Jive, it is also far beyond the operator’s control. Therefore, you need to agree to be careful in all interactions with others, especially if you decide to communicate or meet in person.

IN PRINCIPLE, YOU ARE SOLELY RESPONSIBLE FOR YOUR INTERACTIONS WITH OTHER USERS. YOU UNDERSTAND THAT NEITHER JIVE NOR THE OPERATOR WILL CONDUCT CRIMINAL BACKGROUND CHECKS ON ITS USERS OR OTHERWISE INVESTIGATE THE BACKGROUND OF ITS USERS. JIVE OR ITS OPERATOR MAKES NO REPRESENTATIONS OR WARRANTIES REGARDING THE CONDUCT OF ITS USERS. E.G., NEVIJ RESERVES THE RIGHT – AND YOU AGREE THAT JIVE OR ITS OPERATOR – TO CONDUCT ANY CRIMINAL BACKGROUND CHECKS OR OTHER SCREENINGS (SUCH AS SEX OFFENDER SEARCHES) AT ANY TIME USING AVAILABLE PUBLIC RECORDS.

  1. Discaimer

If and when you act in a manner that harms other users, you are responsible for the consequences. We expressly disclaim any responsibility and liability for your conduct or the conduct of any other person using the Jive application, and expressly disclaim any liability for Pictures uploaded and interaction by you or by any other user.

  1. Miscellaneous
  • The Terms and any dispute or claim arising out of or in connection with it or its subject matter (including non-contractual disputes or claims) shall be are governed by and construed in accordance with Dutch law. In the event there is a discrepancy between this English language version and any translated copies of the Website Terms and Conditions, the English version shall prevail.
  • We reserve the right to modify, amend or change the Terms at any time (a “Change”). If we do this then the Changes will be posted on this page and we will indicate the effective date of the updates at the bottom of the Terms. In certain circumstances, we may send an email to you notifying you of any Change. You should regularly check this page to take notice of any Changes.
  • If you do not accept any Change to the Terms, you should stop using Jive immediately. Your continued use of Jive following any Change constitutes your acceptance of the Change and you will be legally bound by the new updated Terms.
  • If, for any reason, any of the Terms are declared to be illegal, invalid or otherwise unenforceable by a court of a competent jurisdiction, then to the extent that term is illegal, invalid or unenforceable, it shall be severed and deleted from the Terms and the remainder of the Terms shall survive, remain in full force and effect and continue to be binding and enforceable.
  • The Terms set out the entire agreement and understanding between us and you in relation to your use of Jive and supersedes all previous agreements, representations and arrangements between us (either oral or written). Nothing in this clause shall limit or exclude any liability for fraudulent misrepresentation.
  • No failure or delay by us in exercising any right, power or privilege under the Terms shall operate as a waiver of such right or acceptance of any variation of the Terms and nor shall any single or partial exercise by either party of any right, power or privilege preclude any further exercise of that right or the exercise of any other right, power or privilege.
